KIVO Self-hosted licence terms
These terms apply to anyone who buys KIVO Self-hosted. They are written to be read: what you may do, what we promise, and what happens if something goes wrong.
What you buy
You buy a licence to use KIVO Self-hosted, not the software itself, which remains NoirTech Industries'. The licence is issued to the buyer named in the license.key file, a person or an organisation, and it does not expire.
What each plan covers
- Solo: one installation, used by one person or a one-person practice.
- Team: up to three installations within the same organisation, used by any number of its employees and contractors.
- Business: unlimited installations within the same organisation, including its other sites, used by any number of its employees and contractors.
- Lifetime (launch offer): as Solo, with updates that never end.
An installation is one running instance of KIVO, on a server or a virtual machine. Backups, and a stopped instance kept ready for recovery, do not count.
Updates and renewals
The licence covers every KIVO version released up to the “Updates until” date in your licence file: normally 12 months from purchase. The versions you have installed stay usable for good, after that date too.
You can renew updates for another 12 months at any time. A renewal runs from the previous end date if it has not passed yet, otherwise from the day you renew, and arrives as a new license.key file.
What you may not do
- Resell, transfer, rent or sublicense KIVO or the licence.
- Give the image or the licence file to anyone outside your organisation.
- Offer KIVO as a service to customers or anyone else outside your organisation.
- Modify, circumvent or disable the licence check.
- Decompile KIVO or derive its source code, except as far as the law allows you to anyway.
These limits apply to KIVO, not to the open-source components it contains: those stay under their own licences, as below.
Open-source components
KIVO contains open-source components, each under its own licence. The full list and the licence texts are in /third-party-notices.txt on every installation. Nothing in these terms limits the rights those licences give you.
In particular, the video and audio engine (@ffmpeg/core) is distributed under the GNU GPL, version 2 or later. Its complete source code is published by the ffmpeg.wasm project, and for at least three years from your purchase we will send it to you on request, for no more than the cost of sending it.
Support
Support is by email, replying to your licence email, within the response times listed for your plan on the pricing page when you bought it. It covers installing and using KIVO as the guide describes; it does not cover running your server, your network or other software.
Refunds
If KIVO does not work on your server as the guide describes and we cannot fix the problem, we refund you in full within 14 days of purchase. Reply to your licence email and tell us what happens.
With the refund the licence ends: stop using KIVO and delete the image and the licence file.
If you buy as a consumer, every right the law gives you is unaffected, including those under EU consumer law.
Warranty and liability
We commit to KIVO working as described in the guide and on each tool's page. Beyond that, to the extent the law allows, KIVO is provided as it is: we do not warrant that it suits every particular purpose or that it is free of errors. Always keep a copy of the original files you work on.
Except for wilful misconduct or gross negligence, and except for consumer rights the law does not allow to be waived, our total liability is limited to what you paid for the licence.
Your data
KIVO Self-hosted sends us nothing: not your files, not analytics, not usage data. Payment is handled by Lemon Squeezy as the merchant of record, under its own privacy policy. We keep the licence's name, email and code so we can resend it and support you.
Governing law and changes
These terms are governed by Italian law. If you are a consumer, the courts where you live have jurisdiction.
We may update these terms for future sales. Licences already bought stay under the version in force when they were bought.
Who runs KIVO
KIVO is an independent software project by Anouar Jamali, under the NoirTech Industries studio name.
NoirTech Industries is currently a project and studio name, not a registered company. No company registration or VAT details are shown here because none exist yet — they will appear once a legal entity is formed.
